September 2010: Supreme Court case of Tuetken v. Tuetken
In the recent past, parenting arbitration has become an increasingly popular form of alternative dispute resolution in the Memphis and Shelby County area.  Parenting arbitration involves the submission of contested issues to a person other than the assigned Judge or Chancellor for determination.  Most often, the parenting arbitrator is an attorney or psychologist.  The form Permanent Parenting Plan promulgated by the State of Tennessee even includes arbitration as an option under the mandatory alternative dispute resolution section.  The rise of parenting arbitration has raised many important questions.  Is a parenting arbitration award final and binding?  By submitting matters to arbitration rather than to the courts, are parents unwittingly compromising or even surrendering their fundamental right of access to the courts?  Is parenting arbitration even consistent with existing Tennessee statutes pertaining to child custody?  The Tennessee Supreme Court has recently addressed these issues, and rejected the notion of binding parenting arbitration in the case of Tuetken v. Tuetken, W2008-00274-SC-R11-CV.  That case was argued by Adam N.
